Woman, 81, sued after meals-on-wheels worker slips on ice »
Posted by: moemebe 2 years, 11 months agoWaukesha - An 81-year-old Brookfield woman is being sued by Sentry Insurance over injuries suffered by a member of a meal-delivery team who fell on a patch of ice in her driveway three years ago, according to a lawsuit filed in Waukesha County Circuit Court.

Must be a transplant. Most Wisconsinites are pretty hardy folks that don't sue like little babies if they fall in an elderly woman's driveway.

Feb. 3, 2007, 6:22 a.m.That is why I believe that schools should have community service hours in the high school arena. Put some of the teenagers out there to help older people such as this- Everyone benefits from a program like that. I have been stating that for years.....

Feb. 3, 2007, 9:56 a.m.Obviously if this woman needs a meal service, she probably does not have a family member or friend nearby to help feed her -- OR scrape the ice from her walkway. And yes, I agree, "Duh! It's icy!" Nothing new there about Wisconsin.
I hope this 81 year old woman does NOT have to pay.
I put this in the "riduculous case category"... like when I once heard about a thief who broke into someone's house and injured himself trying to escape... The thief had the balls to take the homeowner to court to pay for his injuries on their property. Sickly, the court actually made the homeowner pay! I don't think the thief even went to jail for breaking and entering. Such a crock for a crook!

Feb. 3, 2007, 10:29 a.m.But if someone falls or is involved in an accident their health insurance will not pay. I know a lot of people badly injured with a fall.
If the woman reported the fall at the time there is no stature of limitations. Just like if you get hit from behind in a vehicle. Anything can happen as a result of the injuries.
I think it is Meals on Wheels responsibility. She incurred the injury while on the job-volunteer or not.
I down someone's terra cotta steps while I was housesitting. I could not walk for days. My knee is still bad. I would have used health insurance but I do not have it. I will not sue, she is a friend.

Feb. 3, 2007, 11:20 a.m.As an employee of the company to know you are dealing with the elderly and therefore the steps, etc proabably are not going to be salted. You are doing them a service by bringing these meals where otherwise they would not eat. This should be thrown out of court.

Feb. 19, 2007, 4:02 p.m.I think most people are missing the fact, this suit is being brought by the insurance co. If you trip over your own foot in you neighbor's yard. break your leg, and go to the hospital, if you don't pay for it out of your own pocket right then, your insurance co will sue your neighbor to recoup cost even though you would never even considered it.
