April 4, 2007, 10:58 p.m.Benjamin Houghton, 47, was to have had his left testicle removed on June 14 at the West Los Angeles VA Medical Center because there was a chance it could harbor cancer cells. It also was atrophied and painful.
But doctors mistakenly removed the right testicle, according to medical records and the claim, which seeks $200,000 for future care and unspecified damages.
"At first I thought it was a joke," Houghton told the Los Angeles Times. "Then I was shocked. I told them, 'What do I do now?"

Sad part is male still has the other cancerous testicle? The VA is now going to be afraid to remove that, hoping he will die of cancer so the lawsuit will cease? That was their approach to the Gulf War Syndrome? Agent Orange? Hope there was a trophy jar for evidence?

April 5, 2007, 4:24 p.m.How quickly we forget. This administration and many Americans supported the 250,000 liability limit for medical errors. I remembering hearing the cries of the insurance industry claiming they were getting ripped off by too many high malpractice settlements. People- 200,000 is all you are likely to get today because you all supported making laws that limited insurance settlements. Do you really think people were becoming millionaries from past medical settlements? No- but you were feed a line of crap from the insurance industry and you fell for it. This could happen to you.

Young man with testicular tumor neglected at the West Palm Beach VA. hospital.
He died with metastatic tumor due to failures of the system.
None, even the Inspector General did anything to recognize and therefore prevent future incidents.
We could trace the case, but due to the rules of "Confidentiality" it goes nowhere.

April 5, 2007, 10:47 p.m.Seriously. If you ever need surgery to any part of one side of your body, and you know which side, write in thick black magic marker on your body beforehand. Sometimes the staff doesn't check your chart, or someone wrote it in incorrectly. And when you're under anesthesia, you won't be able to tell them.
It's worth the embarrassment of a bunch of people seeing a giant arrow on your skin pointing to your testicle--with a note reading "REMOVE THIS ONE"--to save yourself even the possibility of future trouble.

April 6, 2007, 8:19 a.m.i work in a lawyer's office. you wouldn't believe 1/2 the stuff i see. failure to diagnose, failure to follow-up, failure to read radiology reports. this type of thing happens ALL of the time. last night i read in my local paper about a guy that had the wrong kidney removed. i went for oral surgery the other day and they ask me what side of my mouth. i felt like saying you're the freaking doctor shouldn't you know. then i go to check out and they ask me when are we seeing you again? i said you tell me.
plus, because of the decades long propaganda against trial attorneys the jury pool is pretty well polluted. it's getting very difficult to win a med mal case. juries are pre-disposed agains them. the med associations and insurance companies have mounted a very effective campaign. like the police, docs do a horrible job of policing themselves. we work on contingency so a case won't even get taken unless it's so eggregious there's a good chance of winning.
