"Viacom had complained that it was unfairly forced to devote significant resources to police YouTube."

And they are probably paying a bunch of lawyers much more than that to deal with this lawsuit and not batting an eye about it. Same with You!Tube.

The whole comes down to money, 99 % of google's income comes

from advertising. They use other people's work to make money, that is what the suit is about. They are doing the same things

to books, sure it is nice idea to put all the books online, but google would have the thing filled with ads, making billions. While authors get nothing.

The only problem is with Viacom's claim is it goes counter to accepted Federal laws related to other intellectual property rights... As in Trademarks, the government requires that you as the owner of a trademark rigorously protect it, the government doesn't require ma and pa to check all existing trademarks before naming their little diner its left up to the Hard Rock Cafes of the world to police it themselves. THis is what Google is in effect saying. Viacom has to accept that its not someone elses job to mind their store its Viacoms. I don't leave a cash register open and unattended and expect the customers to keep someone from stealing me blind why should Viacom get special treatment.
