    The Constitution doesn't apply to Americans. It doesn't apply to foreigners. It applies to the US government.

    There's nothing there which authorizes the Federal government to behave in this way.

        The court did not rule in favor of enemy combatants, it ruled in favor of the constitution.

        This court is truly conservative, and showed it in this ruling.

                this is an insanely misguided decision--when these enemy fighters are in our open US courts with full legal rights..just how does that work--when the ACLU or some other anti-american defense team goes to work--and their real goal..like CAIR..is the defeat of the US-- the main goal of a trial is not aquittal..but damage to the defense and legal systems--who do they call for witnesses..al-sadr??..dick cheney--osama..army generals..??its absurd..and dangerous

                    Am I missing something?

                    If there is suspicion that this dude and others are sleeper terrorists, why not just CHARGE them with a crime? It seems really simple to me. Just charge them, and there's reason to hold them.

                        The Circuit Court is engaging in ridiculous semantics. The fact that the individual is called an "enemy combatant" should be considered a charge in and of itself.

                          The BASIC problem is that we let WAY too many of these A-Holes into the U.S.A. in the first place.

                            Obviously the courts have not abandoned the reputation of the US in the world, with foreign nationals and in our nation. The administration clearly has, but the courts have not. Bully for this judge in doing what has made the US great for 200 years--fairness and following the laws and the constitution. Without these laws, statutes, ordinances and our vast US case law, the US would be nothing, no world leader, no icon of justice and fairness for the world. This appears to be proof that the balancing of the 3 powers in the US does work. And as for wcfields above, i assume you are a full blooded native north american and that your ascendents never immigrated, or you might just have to look in the mirror to complain about "letting too many a-holes in."

                              And with respect to immigrants, i just love people that argue they are "illegal" and so they should never be helped. well, when we as citizens are debating to change the laws, then once the laws are changed they won't be illegal any longer. that's how laws work, if they are cruel and unfair, someone with some brains starts the process to change them. what is formerly illegal one day can be perfectly legal the next day, and this is especially true for immigrants when theirs is only a "status offense", it is clearly not a violent offense against person or property. it's obvious that the 12 million undocumented people in the US are part of an immigration system that simply isn't working.
