Sept. 4, 2007, 1:57 p.m.I have a great deal of respect for Jeffery Toobin, CNN's legal analyst. His book sounds like a good read.

Sept. 4, 2007, 2:17 p.m.I'd love to hear this story from Justice Souter and not from a "journalist" from a left-leaning news outlet trying to sell something.

Sept. 4, 2007, 2:25 p.m.It was completely a political decision based soley on who the conservative majority wanted to be president, with absolutely no foundation in law.
Who ever heard of a close election not allowing a recount? The whole notion in ridiculous.
And the political decision has been devistating to our once great nation. We are weaker, poorer, and more divided than at any time since the Civil War!
Thanks Dumbya! And thanks to you five conservative as**oles on the U.S. Supreme court.

Sept. 4, 2007, 6:38 p.m.A sign that there are still some people in government jobs with a conscience. Resignation would not have changed anything. By staying, maybe his voice will be heard in the future!
Thanks Neo, interesting article!

Sept. 4, 2007, 7:19 p.m.On a slightly different angle to this story, thank heavens Justice Souter remained on the bench all these years. He has been a voice of reason and a respectable jurist. I can understand why he wanted to hang it up, but with Dumbya picking the new Court members, it is better that Souter remained.

Sept. 4, 2007, 9:30 p.m.Not many Supreme Court Justices ready for retirement in the next four or five years, eh? Why'd they all have to leave during Bush's watch? What a lucky guy.

Sept. 4, 2007, 9:46 p.m.Ahhhh, too bad!!!!! The votes were all recounted by different groups and they all agreed Bush won. Quit your eternal griping and crying foul. Even Begay and his reptile friend said Bush won.

Sept. 4, 2007, 10:09 p.m."VANITY FAIR
October 2004
THE PATH TO FLORIDA
As the Florida recount ate away at George W. Bush's margin of victory (1,784 votes . . . 327 . . . 154 . . . ), the machinery of political power sprang to life. In Washington, stunned U.S. Supreme Court clerks watched justice become partisan, while in Florida, tens of thousands of citizensâ;;thousands of them African-Americanâ;;found themselves disenfranchised by misleading, faulty, and uncounted ballots, or inexplicably purged from the rolls."

Sept. 4, 2007, 11:35 p.m.The media (CNN and AP)finished the recount and Gore still lost. This is not news. Maybe Souter wanted to quit but he has made several bad decisions since Gore vs Bush. The correct decision was to stop a recount in specific counties picked by Gore using votes that otherwise would not count. This was designed to give Gore an advantage and was contrary to existing Florida law. It was the Florida Supreme Court that wrote a new law allowing the count to go on. They are supposed to enterprate the law not make new law. The Supreme Court decision (Souter excluded)was the correct decision.

Sept. 5, 2007, 10:01 a.m.Bush has tainted the three branches of government, politicizing the court and judical systems, neutering Congress, and sullying the office of the President of the United States of America. He has condoned the use of torture, unwarranted wiretapping, and uses the US attorneys to go after political opponents. He started a war on lies and false intelligence. He fought the wrong country in his War on Terror. The military defeated Sadam and his army and Bush blotched the occupation and reconstruction. Bush screwed up the government's response to Hurricane Katrina and the reconstruction of the devastated areas. Bush has no coherent and competent way to close our borders. Bush vetos scientific research on religious grounds and not on scientific merit. So tell me you faithful Bushites why you still support this man?

Sept. 5, 2007, 10:12 a.m.I'm very glad to hear of Justice Soutter's reaction. At least there are a few left in Washington with some integrity.
It seemed to me that a total recount of the ballots was what the Florida State Constitution called for, and that the US Supreme Court overstepped the bounds of States Rights and imposed a ruling that had no Constitutional basis in the US Constitution whatsoever. And the Cons talk about hating activist judges. It appears that only when they decide things against the Cons does that come into paly.

What does Souter have to say. Until I hear him say so why would I believe a guy peddling a book?

Sept. 5, 2007, 2:14 p.m.I think this is the same Souter who seeks support for his interpretation of our Constitution in foreign law. I for one regret that he didn't cry his way totally off the court.
