    The Supreme Court has addressed party primaries in the pat, notably in Smith v. Allwright. The political parties, although they claim to be "private clubs," perform a public function, and they can be required to observe standards of fairness.

    Whether the Court will choose to hear this case (if it ever gets that far) is yet to be decided. Personally, I'd bet against it.

      Me too.

      Smith v. Allwright was about the voting rights of Blacks

      The Court overturned the Democratic Party's use of all-white primaries in Texas, and other states where the party used the rule.
