It sounds to me like the Feds need to step in and remind North Carolina of its place. The US Supreme Court ruled on this exact crime and deemed that it isn't a crime at all. Hence, these charges are bogus. As for the assault, that might stick.

Raleigh police are charging two adults for sodomy in private, although the U.S. Supreme Court appears to have outlawed such charges five years ago.
The key point here is, 'the U.S. Supreme Court appears to have outlawed such charges five years ago.'
The issue is, The Supreme either Did or Did Not outlaw this vile act????
Is it Fair to say, Most normal people would think this Putrid act is disgusting and revolting, however, it is a very normal HoMosexual Choice as a life style?
HoMosexuals should and Must have the same Rights as All Americans...
The Police should Not be Involved in HoMosexual Personal Private Conduct.
Ex NJ Governor McGreevey who resigned in disgrace had a Wife, Children, and a Normal mother and Father, however he Choose to Have a Male Lover.
McGreevey may or may not be a HoMosexual, but, it should be be his Choice what kind his life style he Chooses...
Imagin if McGreevey was also an Educator who takes his children to a HoMosexual Parade?
What a disgrace..
