One more reason Bush isn't in Jail is that the senate still is nearly half Roadblock Republicans and the Injustice Department now functions mostly as a political enforcement arm to try to build an eternal Republican monarchy.
But all that's about to change. Bush may not get impeached, but when we have a real Justice Department again, there is a good chance that he and quite a number of his staff will spend time in jail.
If we do not prosecute them, then we set the precedent that contempt of congress, trashing of Constitutional separation of powers, suspension of habeas corpus, the unitary executive, torture and deliberate propaganda are all just fine for any administration that follows him.
