A federal appeals court announced Monday that it has overturned the Pentagon's classification of a Guantanamo Bay detainee as an enemy combatant.

    This has been the point all along. Just having someone say you are an enemy combantant does not make it so. Like any other criminal action it must be proven.

    It took so long because the supreme court took until now to give these folks the opportunity to appear in court and attempt to prove they should not be held. If after 6 years our government cannot prove the accusation, and they can do it in secret if it involved classified information, to a court then the detained deserves to be set free.

    In this society, no matter what the neocon's may wish to think, simply having the president or his designees say something does not make it so. Here you are supposed to be innocent until proven guilty but Bush and his underlings want you to prove your innocence without even giving you the benefit of knowing what you are supposed to have done wrong.

    Small, but a first step getting us back to the constitutional republic we have always been and still should be.

    I've been on a soapbox for some time now ( after watching a Senate Hearing in December 2007 ) and then looking up the Governments case against 517 Gitmo detainees.

    A Professor Mark Denbeaux of Seton Hall University and his group took the Governments own data and put it into a report and they delivered it to the Senate ( It was shown in its entirety on C-Span and as I said above, I watched the whole thing.

    Long story short, something like 93% of the detainees were at Gitmo because they had been sold to the United States Army for a bounty. Nearly all of those rounded up and sold for the bounty were sold by either Pakistanis or Afghans.

    The Chineese were living in Pakistan in a colony.

    The most intresting thing to me was that many of the detainees were named as Enemy Combatants because they knew someone who knew someone who knew either an Al-queda or Taliban. Some were there because they had a Rolex watch.

    We owe for those six years.

      We want truthful answers to questions such as:

      1. Why were standard operating procedures for dealing with hijacked airliners not followed that day?

      2. Why were the extensive missile batteries and air defenses reportedly deployed around the Pentagon not activated during the attack?

      3. Why did the Secret Service allow Bush to complete his elementary school visit, apparently unconcerned about his safety or that of the schoolchildren?

      4. Why hasn't a single person been fired, penalized, or reprimanded for the gross incompetence we witnessed that day?

      5. Why haven't authorities in the U.S. and abroad published the results of multiple investigations into trading that strongly suggested foreknowledge of specific details of the 9/11 attacks, resulting in tens of millions of dollars of traceable gains?

        # How were the FBI and CIA able to release the names and photos of the alleged hijackers within hours, as well as to visit houses, restaurants, and flight schools they were known to frequent?

              You call a country,an axis of evil, then you invade in the name of Democracy and freedom and bomb their country, destroy their poor infrastructure and other facilities. When they resist you and fight you back,you pick some of them up or put pressure on your puppet regimes who live on your hand out to hand some imaginary enemies of yours, and you name them enemy combatant.                 I have not posted for a while, since it was occupying every waking moments, but now I find that unome2 is a LIHOP shill. Say it isn't so. Flights AA 11 and AA 77 never took off on 9/11/2001, and it is quite likely that UA 175 landed in Cleveland. And how many times must it be repeated that jet crashes were no more credible than a cartoon character running into a mountain and creating a body shaped tunnel?

                I guess it's a good thing this has finally happened. Of course, the problem is that if you use some sort of classified information to reach the designation, then you blow your sources keeping a small fry in jail. On the other hand, I'm not sure that happened in this case. It certainly seems there should be some sort of over-sight for the Enemy Combatant designation. Even a FISA sort of court that looks at classified matters. Giving the president and military sole ability to apply any such term is never a good idea.

                For those who think it's a good idea (generally people from the right from what I see), do you really want Obama, and then Clinton to have that power? Who will they declare and Enemy combatant or terrorist? Already terms like economic terrorism to describe the fact that minorities are poorer than whites are floating around. Just wait til someone declares anyone with money a terrorist...

                Just keep both sides in mind.

                I am very glad to read this. The Uigurs are a surpressed minority at home and should not be treated worse in America.

                The state of an enemy combattant that takes away from the detainees all the rights granted by the convention of Geneva had to be inacceptable for a democratic country. A constitution is not only given for the sunny days, but it has to prove its quality and resistance in more difficult times as well. So, a country that is willing to grant constitutional rights even for its enemies has shown much more strenghth than by creating a two-class-law.
