Judge Rejects Bush's Stance On Wiretaps »

A federal judge said that President Bush does not have the constitutional authority to overstep the law establishing the government's ability to conduct warrantless wiretaps on American citizens. FISA, in 1978, established the 'exclusive' means for engaging in wiretaps, and the president in his capacity as commander in chief can not evade that law.

    This ruling says that FISA trumps the "state secrets" defense that this administration is using in 40 other lawsuits.

    This Judge is wasting his time. Bush & Republicans are the law of the land until 1/19/2009. God willing, it will end on 1/20/2009 if a Democrat wins the WH.

    It seems like there is no end of this administration's attack on the Constitution. They just don't want to follow the law even when the Supreme Court rules against them.

    At least one judge has the guts to take the lead on this issue. This is only one of many issues that this administration has subverted the Constitution on. Maybe more members of the judicial branch will step up and begin the process of returning our constitutional freedoms that have been destroyed by the Republicans.

      more proof of impeachable criminal acts.

      -for those pointing to the patriot act- a) it doesn't approve this b) even if it had, it wouldn't matter because legislation can not trump the constitution, nor can it trump other legislation unless it SPECIFICALLY AMENDS that legislation. you can not just make contradictory laws and then choose the one that works. nothing in the patriot act amends the FISA laws.

            You guys need to read the Constitution. Not the abridged edition with all the pictures, but the real one. The Kennedy's were spying on everyone in the Sixties and Bobby wasn't even President. You guys go out and play and the adults will watch out for the bad guys. You are one paranoid bunch to say the least. You want to give the enemy individual trials because a handful of Lib judges say so. If Bin Laden is captured does he get a trial ala OJ with the presumption of innocence. Let's run everything through the courts, they are quick, efficient, and inexpensive. Wake up gang!

              Economy was doing okay until the housing runup crashed. And in your simplified world Bush caused that. Sadly you guys always wanna get the rich.
