Ah, the old 'Poisoning the Well' fallacy.

Ah, the old "Let's pretend that voters in most states haven't rejected gay marriage" fallacy.

That argument is getting old. It has been proven over and over that a law that discriminates is not constitutional which is what interpreting the law is for. That's what courts do. They interpret the law. If a law is unconstitutional, such as the sodomy law, then courts must overturn them.

Understand? It's really not that hard. And you are sounding like a broken record.

You can't just overturn a U.S. Constitutional Amendment in a legal case. Big difference.

When has a judge overturned a Constitutional Amendment? Judges can overturn laws that are in conflict with a constitution.

This isn't about overturning a Constitutional Amendment. You are the one who is talking about using a Constitutional Amendment to DENY rights to people instead of GRANT them which is the point of the Constitution in the first place.

Circle speak again. Do you even read what you type?

To further bolster your point: The Constitution is not about granting rights at all. Rights are ASSUMED. The Constitution specifically prevents inherent rights from being infringed upon. It doesn't even give the full list of all our rights.

The Colorado Defense of Marriage Act was passed in the legislature, so we didn't have a chance to vote on it.

Again, it's the argument that the majority is always right when that has historically not been the case.

While the majority of Americans are still opposed to gay marriage, polls have shown demonstrable treans towards tolerance.
