Why is the Supreme Court's decision to uphold habeas corpus rights for the Guantanamo detainees so scary that Senator Lindsey Graham, with the support of McCain, will "explore the possibility, if necessary, of a constitutional amendment to blunt the effect of this decision"?

      I believe the Constitution is pretty clear on when habeas corpus can be suspended, and it doesn't have any stipulations on when, where, or who either.

        Throwing out bedrock legal doctrine of the western world for almost 800 years should be a pretty consequential thing... to do so would indicate truly un-American behavior! Amazing thst we were only one vote away from doing so.... America is regressing in its civilization! Well, the Repugs gave us the Great Depression too!

        Because, all those who are held at GITMO are people either kidnapped off the streets by CIA or handed over by bounty hunters in Pakistan. The Bush crooks have no case, no evidence and no witnesses to charge these people with anything. It is a ploy to let dumb Americans know that they are terrorists and threat.

          They are after Habeus because it is the keystone upon which all other legal protections depend.

          I say "legal protections," not rights. Rights flow from the human spirit, and like muscles, they are strengthened when exercised, and atrophy when neglected.

          We have grown to soft and dependent on the state. Time to exercise our human rights. We don't need the state's permission.

            Was it only honey for the bees, when John Mc Cain argued so engagedly against Guantanamo? Has he turned into a hardliner in national security? The Habeas Corpus Act is one of the basics of civilization, role model for most of the world´s democratic constitiutions. How can someone who has learned by experience what it means to be a prisoner of war (and: "enemy combattants" don´t even have the minimal rights of a POW!) question that everyone, no matter what he or she is charged for, is proteced by the Habeas Corpus Act? Who doesn´t accept even this elementary human rights as given to every human being, not to forget that this act mirrors the state of the art of the 17 th century, should think about for whom he stays votable for president!

              I don't see the usual plethora of conservs in here accusing us of being unpatriotic. The Military Commissions Act claims to offer protections to those seized under it but specifically states that when someone is seized as an enemy combatant, no court can contest their status.

              First, the article is wrong in it's closing remarks, this is a war and terror has been the target. We've been at war with Islam for almost 30 years. It's been brewing since the murder of our ambassador in Afghanistan, 14-Feb-1979. Every year or so the attacks increased. A huge mistake made during the late 70's was our signing of a UN resolution recognizing non-uniformed people, trained for and conducting covert military actions. In the past 5th columnist people were treated as spies. No quarter expected, none given. It was an anti-Israel gift from Carter to the PLO. We should never have give rights to terrorists. When someone is willing to behead, blow up or even nuke innocents, no rights under our laws should protect them.
