I say yuck. It's a lawsuit. Attorneys are icky, bad, demonic people who only want to steal money from the rich hard working all-deserving cons and make their lives miserable.Or at least that's what cons usually say when they are being prosecuted or investigated for something. I don't know the substance of this case (actually I'm sure there isn't any) but you should be defending Obama from the bloodsucking attorneys and "activist judges." Have a heart, cons (ok, well do the best you can). ;-P

Obama to me certainly seems to qualify in every sense to be a candidate for and be the next President. This is a total waste of time, agreed, as much a waste of time as the attempts to initiate impeachment proceedings against Bush. It goes to show the extremes some go in this country.. I must interject, however, that while this is an attack to muddle up the election process, it's certainly not a "swiftboat" attack. There was a lot of truth to the swiftboaters allegations, there is absolutely no truth in my mind that would lead me to believe Obama is not eligible to be President.

2. At least one parent lived in the United States prior to the child's birth.
For persons born on or after November 14, 1986, a person is a U.S. citizen if all of the following are true:
1. One of the person's parents was a U.S. citizen when the person in question was born;
2. The citizen parent lived at least 5 years in the United States before his or her child's birth; and
3. At least 2 of these 5 years in the United States were after the citizen parent's 14th birthday. -

This link also contains pictures of reporters holding the birth certificate of Obama as well as the raised seal and many other things.
If he has a valid birth certificate, as he apparently does, doesn't that mean he was born where the certificate says? It says he was born in Hawaii. That makes him a citizen.

Panama was a US territory when John McCain was born there and as you said I think, and both McCain's parents american citizens. Obama COULD have been born in Kenya, American Mother, Muslim father from Africa. When his mother tried to get back into US while she was expecting Barack (Barry), the airlines turned her away because she was late term pregnancy. She MAY have had him in Kenya, went to Hawaii 4 days after his birth and was said to have had the birth recorded in Hawaii as his birth place.

The difference is that Obama has only one parent that was a US citizen while McCain had two parents that were US citizens. If both were born outside the US then ONLY McCain is a real citizen. Therein lies the problem. The law at the time for both requires both parents being citizens if born outside the US and at least one of them residing here after that. The law was changed after that to be just one.

FTA-However, FactChecker.org says it obtained Obama's actual birth certificate and that the document was indeed real. The site discredited some of the claims of Internet bloggers, such as that the certificate as viewed in a scanned copy released by Obama's campaign lacked a raised seal. FactChecker.org also established that many of the alleged flaws in the document noted by bloggers were caused by the scanning of the document.
A separate WND investigation into Obama's birth certificate utilizing forgery experts also found the document to be authentic. The investigation also revealed methods used by some of the bloggers to determine the document was fake involved forgeries, in that a few bloggers added text and images to the certificate scan that weren't originally there.

You can look this up on the state department website. A person does not lose American citizenship if s/he is automatically granted citizenship to another country, e.g. for instance if your parents drag you to another country and you get granted citizenship.
It all depends on the intent of the person, such as applying for citizenship on one's own.
We have to look at what Obama did after he became old enough to decide.
The answer seems obvious.-

In this case it matters where he was born. That is going to be the deciding question. If born in Kenya to a citizen of Kenya and a citizen of the US then he is not a US citizen. The law at that time requires both parents to be US citizens.

This is the point that I am curious about. The grandmother and siblings saying he was born in Kenya, might possibly match the time frame for her to return to Hawaii in the four days to file for the birth certificate. If he was born in a hospital in Hawaii, then there should be some sort of hospital records, i.e. doctors and nurse reports, hospital and/ or doctors bills especially. You know any doctor is not going to deliver a baby without sending a bill, there has to be a copy somewhere. Another thing here is, what mother would travel half way around the world to file paperwork with a child that is only a day or two old. Did she leave the baby in Kenya, file the papers, then go back for the baby? But why go thru all this added hassle, why not file the paperwork in Kenya? Did she know 47 years ago that he would need to be an American citizen in case he wanted to run for president some day?

I dress up in gray and paint my self gray and I go and stand very still in the park while holding a flag, and everyone thinks I am a statue. Even the pidgeons darn them darn them.

In the Naturalization Act of 1790 Congress defined “natural born” to include children born abroad to citizen parents. Although the language was not kept in later naturalization laws, that specific language was not challenged.
Persons Born Outside the United States to Citizen Parents:
This bill clarifies that the term “natural born Citizen” includes children born outside the United States to citizen parents. This provision provides comfort and certainty to members of the American military and foreign services, as well as expatriate families, that their children, too, are eligible to run for president. These children are no less qualified than children born on American soil, and they should not be treated differently. Of course, children born to American citizens abroad would only be eligible to run for president if they satisfied the fourteen year residency requirement in addition to the “natural born” requirement.
Support for the position that the term “natural born Citizen” should include children born outside the United States to citizen parents is particularly well articulated in a law review article by Jill A. Pryor entitled The Natural-Born Citizen Clause and Presidential Eligibility: An Approach for Resolving Two Hundred Years of Uncertainty. This article argues that “any person with a right to American citizenship under the Constitution, laws or treaties of the United States at the time of his or her birth is a natural-born citizen for purposes of presidential eligibility.”-

the Hawaii state dept. of health (the body that issues birth certificates) has already released a statement saying Obama was indeed born in Hawaii and that his birth certificate is indeed valid.

It is truly amazing to me how quickly people tend to jump on negative, fear-producing political tricks as fact. Does any one out there sincerely believe that the Democratic Party and some of the most influential people in this country would have put over 2 years worth of time and great amounts of money into the Obama candidicy of someone had not thoroghly made sure he was eligible to run? Give me a break!!! As for the law suit, I assume this was just a way to throw more lies and confusion to the american voter. Apparently, the plaintiff is asking for either:
1. the authoritative paperwork pertaining to Sen. Obama's citizenship, or

The Obama campaign has said he was in Pakistan for about 3 weeks, staying with his friend’s family in Karachi
But what was happening in Pakistan at that time?
Pakistan was in turmoil in 1981 and ruled under martial law.
Pakistan was on the banned travel list for US Citizens at the time and all non-Muslim visitors were not welcome unless sponsored by their embassy for official business.
The Afghan Mujahedeen were based in Pakistan during this period and fighting the Soviets in Afghanistan

Since Obama never was qualified to run for President, should the Democratic National Convention nominate him anyway and he be shown to be unqualified afterwards, there would be no Democrat on the ballot in November. This would limit the voters' choices to McCain, Rader, and a few independents. The Democratic Party would be wise to resolve this immediately. I love it when Truth is exposed as everyone is better of then. There is a possibility that Obama and a few of his aids may go to prison before this story is over. It is only a civil case right now, but fraud and perjury are crimes worthy of incarceration.

You're not thinking, nor paying attention to the entire issue! He could not have the Indonesian passport without being an Indonesian citizen, meaning at age 20 he was not a U.S. citizen. Naturalized citizens are unqualified to run for President. Read the Constitution!

Yeah, you might want to read this. He was born in Hawaii. He moved to Indonesia when he was young. Thus, the Indonesian passport. He moved back to the States where the majority of his schooling took place when he was young, as well.
Now, are you going to tell me that this is a fake? Its not the same picture you keep bringing up. This is a legit birth certificate, Hawaii says so, WND says so, Obama says so, McCain says so... only a few crackpot conspiracy theorists (a large number of whom believe 9/11 was Bush's doing, actually) believe otherwise.
I've probably forgotten more about the Constitution then you ever knew. Do you know that the US army cannot be funded by Congress for more then two consecutive years, for example?

The Constitution says that the President must be a natural born citizen. Since at that time they were only thinking of the Continental U.S. and did not anticipate U.S. territories out side of the mainland, that is why it was written like that. Army posts, and other lands that are considered United States makes anyone born a natural born citizen. If a person was born outside of territory not protected by our rules of american parents, at the age of 21, he/she can declare citizenship of either the U.S. or that country of birth. I may not like Obama, but he is a natural born citizen.
