Indeed, gouvernment should not intervene in private matters, as long it doesn't harm a third person, nor hinders this 3rd person freedom.

e.g.
If you want to smoke in your home, or in open air (or big halls), and that smoke doesn't (objectivaly) bothers me.... what's the problem, it's your ADULT live.
If you own a restaurant, pub, bar,..... it's your choice to make it smoke free, smoke area, or smoke everywhere. After that it's the customer's choice either to come in or not.
It's you choice to eat to much fat or not.
It's your choice to sit the whole day (after work) in front of the TV, or to get out and do some sport (better for you).
etc.....
The gouvernments task and duty is to INFORM you on the consequences or possible consequences of your decisions (actions, eating habits, work, .....).
It's also their task to make sure others are not harmed by what "other" others are doing..
e.g. smoking: you don't have to go to a bar where smoking is partly or not allowed. Go to another. However, you do sometimes HAVE to go e.g. to city hall, so that should be no smoking (except maybe in big townsin the lobby where that loby has a "100ft high" ceiling)
Same goes for religion,gays,prostitution (NOT pimping or forced prostitution), mariage,...-

Not everything that the gouvernment does or has to do is neceseraly tto be found literaly in the constitution. (and in this case you're obviously talking about the US constitution.

I was speaking of gouvernments in general, all over the world.
Live becomes more and more complicated. It is (almost) impossible for normal citizen to know everything. Even on the internet information is to big and some times not to be trusted.
However, gouvernment has the possiblily to examen all things and find out if they are harmful or not , if they should be allowed or not (e.g. killing some one, hearting some one, stealing, cheating on quality, ..etc...... should not be allowed.
e.g. as a private citizen, I can not know if hrmones in food are bad or not. Gouvernment can, and should inform.
