Alaska Governor Sarah Palin' s reaction to the Troopergate ethics investigative report released on Friday, October 11, 2008 by the Alaska Legislature.  Seems she has an entirely different take on the findings of the bipartisan legislative body who concluded that Gov. Palin' s conduct “ violated AS 39.52.110(a) of the Ethics Act…”   But, according to Gov. Palin, she is “ very very pleased to be cleared of any legal wrongdoing … any hint of any kind of unethical activity there. Very pleased to be cleared of any of that.”   Just what ethics report did Governor Sarah Palin read to come up with that spin?

      Palin should be a horrible embarassment to John McCain, she certainly is to those of us who trusted him to pick a credible vice-presidential candidate. This is the latest issue in a long line of issues, that has me questioning his judgement in his choice. I am no wondering if he really is the best choice for president.

        The only explanation of McCain choosing Palin is that he didn't. I think he was taken into a cigar smoke filled room by the Hannity/Limbaugh wing of the party and told to pick a mud slinging VP who they will be more then glad to provide or he would be on his own. You can sometimes see it on his face at these rallies lately. He is saddened by the fact he had to make a deal with the devil to keep his campaign afloat.

          McCain wanted Liebermann, straight up, and everybody knows it. He thought that would be just the rub. Funny thing is, that is probably the only choice he could have made that would have been worse for his campaign on more levels. The party trumped him on that, and gave him Palin (I smell Rove here). He never met with her because he didn't care, because they had the audacity to pick his running mate for him over his own preference, so obviously what he thought didn't matter.
          That is what went down. John McCain is the CONs handpuppet.

                  If she's been found to be guilty of an ethics violation now... what would she bring to the White House? She's lied before. She'll lie again.                     The trooper in question did according to the state troopers threaten to kill Palins father, taser his step child so he could feel what it felt like, drank on the job, and hunted moose without a license on the job.

                    For that he was given a 5 day suspension.

                    What would you do if a law officer threatened to kill your father?

                    Then the report contains such damning things as "was likely a contributing factor" and "engaged in ‘official action’ by her inaction". They didn't know the reason but they guess. Her inaction could be cause by such a thing as lack of knowledge but that was not mentioned.

                    So the liberals are left with a bunch of gobbledegook that has nothing concrete but trying to read her mind.

                    Listen to them yell how hateful she is.

                      People that took the law in their own hands were called vigilantes and the practice was outlawed decades ago. So with your support of someone that would took the law in their own hand puts you in no position to question the opinions of other people on here.
                      Palin took it upon herself to be the judge jury and executor of a personal situation that she should have removed herself from due to conflict of interest. By not removing herself from the issue she abused the power of her office of Governor by allowing her husband who had no legal capacity to perform duties of Governor to push for the troopers removal and not going through the proper channels to remove the trooper who was a government employee. By abusing her power as governor, she has shown her lack of knowledge and law to handle a crisis as trivia as this one for the state of Alaska. She is not qualified to be Governor of Alaska much less the Vice President of the United States.
                      In other words, she's another W with lipstick but more dangerous if that's possible.

                        Word is that Todd got to do a lot of things in some sort of weird quasi-official capacity. Much of which consisted of his own personal agenda for the state, and supposedly expenses were paid for. The "first dude", as they call him.

                            While I don't think this reflects positively on Palin ("bad form"), it's clear from the amateurish report and its brazen attempt to pin something on her that she ultimately did nothing wrong that is anything near actionable. It also paints a picture of primitive, perhaps naive development in Alaskan statutes. It's astonishing that there's nothing on the books that gets any closer to this episode than a chapter on personal enrichment. Perhaps that is a good thing...maybe there's not as much corruption up there as the rest of the country, so their patchwork codes are behind ours.

                            But notice that while the libs in here dissect every finite aspect of this episode, they are content to ignore the gaping holes in credibility left by Obama and Biden. Lacking the first moral or ethical standard themselves, they do not dare apply to Obama or Biden the standards expressed in here against Palin.

                                Why? She said she'd fully co-operate with this investigation but then refused to testify and directed a number of people from her office to refuse to co-operate with this investigation citing executive privelege (sound familiar?). I'd rather hear from an investigation started by a bi-partisan, Republican controlled senate. That is this one.

And besides, the panel was NOT the proper authoritative body to investigate in the first place. The Personnel Board is as they are the ones empowered to investigate breaches regarding ethics.                                       An Alaskan court ruled that the legislative investigation was indeed proper as part of the legislative oversight of the executive branch.. She might cooperate with the Personnel Board investigation because she appointed all three members of the board. That may change too because her three republican appointees chose a democrat to conduct the investigation. On the other hand they will probably say that with a democrat investigating that it was flawed from the start. The fact of the matter remains that the legislative committee empowered by a unanimous vote of the legislature found that she violated state ethics laws.

                                That is 100% correct, " .. cleared of any legal wrongdoing". She didn't commit a crime, therefore no legal wrongdoing. And she didn't refuse to testify. Instead she made the correct call by insisting that the correct investigative body is the "Personnel Board" and that she and her husband will in fact cooperate with that board's inquiry at the end of this month. Not only that but the taxpayers of Alaska had to foot the bill for the obvious witchhunt - partisan BS, nothing to do with Dem or Repubs, personal vendetta is more like it.

                                You know ... it's one thing to be FOR your candidate and AGAINST another's candidate but when you spread all the lies and hate filled "out of context" mish mash of selected diatribe to suit your own agenda, then you're doing more harm than good because the readers get to know who you are and simply dismiss the posts/replies, etc. and have a very strong tendency to vote for the "other" guy.

                                    Palin's statement (and by extension your statement) that she has been "cleared of any legal wrongdoing" is not borne out by the very words of the report that she claims as support.

                                    To be clear I will quote directly from the report,

                                    "Finding Number One

                                    For the reasons explained in Section IV of this report, I find that Governor Sarah Palin abused her power by violating Alaska Statute 39.52.110(a) of the Alaska Executive Branch Ethics Act."

                                    I don't see any gray in that quote. I don't see how your claims of "out of context mish mash of selected diatribe" in any way mitigates the clear and unambiguous statement set forth in the report as Finding Number One.

                                    Palin violated a specific section of an Alaska statute. Surely that qualifies as "legal wrongdoing" Would you please explain to me that the report "cleared [Palin] of any legal wrongdoing" as the Governor claims and as you support as 100% correct?

                                    Your position, like that of Governor Palin's doesn't make any sense.

                                          Ms Palin is eitgher the biggest liar in presidential Election history, or the most stupid one. What does she understand by the charge from the Bi-Partisan commission thast found her undeiably guilty of breaking the ethics committe rules, She is charged with using her position in office to try and get her former brother in law fired from the Alaska State Troopers. She has not been exonerated, but found guilty of these charges. No amount of denial is going to sweep this away now that she further incriminated herself by claiming she has been cleared. Someone in the Republican Committee should tell John McCain to drop her now.

                                            You really need to read the report youself before you make yourself look any dumber. Everyone of you are going by what MSNBC says or CNN. The fact is, this board as you call it has NO legal power and did not sight any criminal charges. The ethics issue comes from her husbands side and is basically because of one mans testimoney.

                                            It was also said no reprocussions would be sought or reccommended. If you truly read the entire investigation and put yourself in their pplace, you most likely would have done the same. This started before she was a Govoner, and has been stated by many that these ethic charges do not meet the criteria this panel is saying. Everyone has a right to their opinion, but take the time to read this report and then decide. By the comments of these posts, most of you have not.

                                              I have read the entire 200+ page report. Therefore:
                                              1. Finding No. 1 of the report states that Palin "abused her power by violating Alaska Statute 39.52.11(a) of the Alaska Executive Branch Ethics Act." Violating an existing statute is by definition breaking the law.
                                              2. The report itself later uses the word "unlawful" in describing her actions.
                                              3. Legislatures always have power to investigate alleged executive branch misconduct, in every state in the union as well as the federal level. It's part of the U.S. and every state constitution, including Alaska's. You can read the Alaska Constitution online.
                                              4. Two courts, including the Alaska Supreme Court, ruled within the past two weeks that the Alaska Legislature had the right to conduct this investigation. This was based on the Alaska Constitution and precedent. You can read these rulings online.
                                              5. The report did not say that no repercussions would be sought. It simply left it up to the legislature to make that call. That is different than saying none will be sought or that none were recommended. Again, you can read the report online.
                                              5. This did not start before she was governor; that is, the actions covered in this investigation pertained solely to her role as governor, so it couldn't pre-date her term. The investigation itself was launched in July of this year. Her attacks on Trooper Wooten did start before she became governor, and a court warned her and Todd to cease and desist such actions. But those actions were not part of the conclusions in this investigation. Again, you can read the report.
                                              6. She lied publicly not only about her willingness to cooperate in the Legislative investigation (she said she "welcomed it"), but also lied about the pressure applied concerning Wooten's employment. She has said neither she nor Todd nor any of her staff initiated any contact. Then she said her staff initiated contact without her knowledge. Then she said Todd initiated contact without her knowledge. She also contradicted herself on numerous occasions about the reasons she fired Monegan.
                                              7. The only part of this issue the report said was legal was that the governor of the state of Alaska does have the legal right to fire at-will employees. But that is an entirely separate issue than whether there were abuses of power in the events leading up to the dismissal. It is not a hair-splitting point. For example, a police officer has a legal right to discharge a gun in public, but the actions and reasons for a shooting may still be illegal and subject to investigation and punishment. Having a right to do something does not give anyone - you, me, a cop, a governor - carte blanche to carry it out for any reason at all. That is totalitarianism.

                                                I read the entire report and A.S. 39.52. A link to that statute is provided below. A.S. 39.52 says nothing of abuse of power. The word abuse does not appear in that entire chapter. It deals with, defines, describes, and assesses penalties for, personal or financial enrichment by an official's use of his/her office.

                                                The desparate, gasping, hyperventilating, masturbatory Democrats in search of a petard for Palin ended up hoisted on it themselves. How embarassing. Now the entire nation knows that Democratic Alaskans are functionally illiterate and cannot demonstrate familiarity with their own laws--even when they know the whole nation will be looking over their shoulders.

                                                Fortunately, this is not an embarassing situation for shameless people.

                                                Ok...I know this is like telling a liberal in a round room to go take a pss in a corner, but this is where you get to go off and cite portions of the report and/or A.S. 39.52 that you believe will prove me wrong.

                                                      Funny, no one is debating that. However, since you have not read the report or anything about the report I will summarize.

                                                      Like Bush`s firing of the AGs for political reasons, Palin had every legal right to fire Monegan. However, she fired him for unethical reasons and not performance reasons. She and her husband also acted in very unethical manners.

                                                      As Governor, when she was sworn in she took an oath to abide by the rules and laws. The Republican dominated commission investigated and found Palin broke the ethical rules.

                                                      Plz feel free to try to explain why a Republican dominated commission would do a Starr-esque witch hunt on a fellow Republican.

                                                      Her behavior was simply an abuse of power.

                                                      I hate to bring all of you people who want to pick apart everything this lady says, but in this case she is correct. On Sunday news yeasterday they talked with two lawyers and a judge who said that they felt the hearing was wrong on the ethic issue. It was their opinion that the Govenor had handle it OK as their was no personal gain or monetary gain. They said that personall gain means by governmental statndards, she would have to do something that would gain her a higher position or job, which in this case she already has the highest job in Alaska. They said monetary speaks for itself. These people also said the fact that the panel had no clear insite on how Palin could have handled it any diffently, which is a clue they had no better means of handling the situation themselves is a good indicator.

I've really tried to look at both canidates fairly. This is an important election, the country and even the world right now is a mess! There arn't enough resources to go around with the rapid growth of China and India.                                                                                   It's a lengthy read. The report findings cite Palin as being in violation of A.S. 39.52.110(a).

                                                                                  You guys tell me. The entirety of Chapter 39.52 appears dedicated to the issue of personal or financial ENRICHMENT by a state official. There is nothing in the entire chapter that addresses other areas of executive misconduct. If true, the investigation was grasping at straws and came up empty-handed.

                                                                                    You are somewhat mistaken, but the "somewhat" is quite a big somewhat. Alaska Article 02 CODE OF ETHICS Sec. 39.52.110. Scope of code, says: "The legislature reaffirms that each public officer holds office as a public trust, and any effort to benefit a personal OR (emphasis added) financial INTEREST (emphasis added) through official action is a violation of that trust." It says personal OR financial, and does not say "enrichment," as you suggested, it says interest. It was most certainly in her personal interest to exact revenge against a man she perceived as creating problems for her family. I read the entire law this weekend, I just downloaded it now via your link as a Word file and searched for the word enrichment, and could not find it mentioned even once. Did you switch words inadvertently? If so, no big deal, but it would be nice if you would repost with a correction. I certainly hope you did not purposely place the incorrect word in your paraphrase of the state law, for that would not only be deceptive, deceitful and dishonest, but downright unfair and un-American. We are all supposed to live by the laws as written, not as we would like to re-write them, whether for ourselves or candidates we support. Guys, what kind of country, what kind of society are we going to have if we continue to play these kinds of games. Geez. Just admit the person you're supporting did something wrong, and move on. Keep supporting her, don't keep supporting her, whatever. But we've got to quit this lying to try to re-make reality to fit our biases. Let's all grow up here. And, here again, I don't want to be mistaken for condescending again, but true is true, false is false and disingenuous is disingenuous.

                                                                                      There's no need to provide emphasis. If you had read A.S. 39.52 in its entirety, you would have found the statutory definition for "financial interest" toward the bottom.

                                                                                      (9) "financial interest" means
                                                                                      (A) an interest held by a public officer or an immediate family member, which includes an involvement or ownership of an interest in a business, including a property ownership, or a professional or private relationship, that is a source of income, or from which, or as a result of which, a person has received or expects to receive a financial benefit;

                                                                                      Even with the normaily heavy, sharp crow bar used by liberals to distort the plain meaning of words, there's no way in hell you can interpret the above to include removing someone from office, unless you can tie dollar signs to the act.

                                                                                        The dispute isn't what financial interest means. You keep forgetting the key part: "personal OR financial interest." If you were dissecting and re-building the sentence for the hard of reading, it would state "to benefit a personal interest or a financial interest." The law doesn't say interest twice because that's not how we use grammar. The two are parallel uses of adjectives. The OR is a conjunction, connecting two separate ideas (personal, financial) both modifying the same noun (interest). You can act in your personal interest and break the law here, or you can act in your financial interest and break the same law, or you can do both and break the law. One, or the other, or both. You are misreading it entirely, either purposely or not. Your reading of the passage not only defies logic, it defies the basic tenets of English grammar. You are misreading the sentence. If it said ONLY a financial interest, you'd be correct. If it said "a personal AND financial interest" you'd be correct. But it doesn't. You can't ignore the OR, anymore than you can change INTEREST into ENRICHMENT. You can't rewrite it on the fly to suit your needs. And "DUDE" (is this really Todd Palin, not Georgia50?), the first rule of a battle of wits is to come armed. Until you take a refresher course in basic English grammar, I wouldn't talk about who is digging a hole. BTW: Are proper grammar and good reading skills now part of the liberal/conservative split? Grammar now depends on your political persuasion, Georgia50? Heaven help us. Liberals don't use a crowbar to twist language, conservatives use one to bash what they can't or don't want to understand. If you re-read it and still can't see it, I now know why test scores are down. Somebody who values language and meaning over politics please chime in here!!!

                                                                                    Bottom lone: she and McCain have created a toxic political climate from which their party suffers and will suffer greatly for a long time to come.

                                                                                    For example, post the election, how are they going to reintegrate the foamers into a reasonable discourse that will serve common goals--ironically, serve their OWN needs?
