Rachel Love's lawsuit accuses Johnny Utah 's in Rockefeller Center of negligence and "assault and battery." It says the restaurant allowed "an inebriated individual" to ride the bull.
Love's lawsuit says while she was riding the bull on Jan. 31 a Johnny Utah's employee increased its speed, making it "become more violent" in an effort to throw her off. Her lawsuit seeks unspecified damages. It doesn't detail her injuries. (In the YouTube video below, a citizen journalist visits the Rockefeller Center Johnny Utah's--not, however, on the night Rachel Love went airborne.)

Everybody on the face of the planet has the ability to make choices. Some people make better choices than others. Our legal system allows the people who make poor choices to blame others for these poor choices. The choice was to consume alcohol to the point of inhibition. How about making this woman to go to rehab, and maybe learn to make better choices. Not be rewarded for poor choices.

Facts to consider;1.bars are made for drinking $$ 2.the bull is placed in a drinking bar to attract customers and keep them around 3. was she drinking or intoxicated 4. was it girls drink free all night 5. did she assume the risk for only a few minutes on a slow moving bull 6. did she yell stop/slow down/etc 7. did the operator ignore her request to get off (assault/battery) and negligently/purposely increase the speed against her "responsible" request 8. did type of problem occur before 9. was the operator trained to know when a customer is in danger or too drunk

This reminds me of that Pace Picante commercial where the pseudo-cowpoke brought salsa from NEW YORK CITY!!! Ahh haa ha. Or how about the Billy Crystal movie, "City Slickers"? Sorry. But apparently New Yorkers are unable to grasp the concept of riding a mechanical bull, God love 'em. The idea is you ride until your ride is over. And when is your ride over, urban cowboys and girls are wondering... WHEN YOUR ASS HITS THE GROUND, YOUR RIDE IS OVER! This restaurant, Johnny Utah's will continue to face lawsuit after lawsuit until they shut down the mechanical bull because of mewling patrons like Rachel Love. The honest answer to this dilemma? Rachel Love says, "It's because I got drunk and rode the mechanical bull", instead of "I got a snoot full and the staff at Johnny Utah's didn't babysit me properly."

This country is run by lawyers, these bottom dwelling scum bags make up the rules and there's no such thing as personal responsibility anymore. If there wasn't a hungry attorney out there attempting to fabricate a case she would not be able to sue. We need to institute a system whereby any potential law suits are initially reviewed by an independent committee to determine if it has any merit.

You mean to tell me that the guy running the bull deliberately tried to make her fall off? And she was drunk? I've ridden the bull many times, never sober. Thats how it goes in a bar. I fall off, get up, and go back to my drink. By the way inspiring, I'm a NYer and I'm probably better than most at riding. But I promise not to make my own brand of salsa. Can't cook worth beans anyway.

Let's not talk about the moron that decided to seek legal action for her drunken stupitidy. Unfortunately the United States is way too full of people like her. Let's talk about the overwhelming need to reform the judicial system. We made a major mistake when we put private enterprise in charge of the most powerful branch of our government. Attorneys are independant businesses but most people don't realize that. When we gave them the golden key to the city and all the power that was unfortunately bestowed upon them without any or very little control of that power, it was only a matter of time and we are now reaping the seeds that were sown. Wouldn't it be a wonderful world if each of our given industries was legally given the right to police themselves. When you're done laughing at that one... realize that's what happened with our system of attorneys, which is the core of the judicial system. It's called the BAR Association. An organization of attorneys policing attorneys.

So, if they had tried to physically restrain her and keep her off of it because she was drunk, would she be filing a lawsuit against them for protecting her life? She ought to just be glad it was a mechanical bull and not the real thing and shut up! What a stupid tramp.I hope her lawyer sucks her dry and then looses the case.I have a lawsuit happy EX friend and her husband(i got sick of her scamming ways)She is currently suing McDonalds (she is 400lbs) because she fell in the restroom and hurt her knee.What she failed to mention is I have seen her knee give out FROM her weight a number of times BEFORE her lawsuit.

Both parties are at fault here.The restaurant should have made her sign a waiver before she even got on that thing.If she was drunk,they should have noticed and cut her off.As far as she is concerned,those are the ups and downs of life.She chose to ride the bull,she got hurt,too friggin' bad honey,that was her choice.Take your lumps and get over it!!

Do people realize, that this type of situations costs all of us? If someone sues for, as an example, burning their finger on a match, and wins because the match manufacturer didn't tell them that fire might burn them. Every single match manufacturer, will modify their packages to put "warning - fire can burn you." That modification, increases their cost, and raises the price. Look how many common sense warning labels there are on things we buy every day. We're paying for it because some dumbass decided to sue, found a lawyer to take the case, and a judge let it enter their courtroom. Oh yeah, our tax dollars are paying for the court proceedings too.

It's like the story of the woman who sued ta carnival operator because she was dizzy after a merry-go-round ride. She tripped on her own feet after the ride, tried to sue for neglect because there was no warning of possible dizziness from such a ride...

I go to a bar that has a mechanical bull and they make the person sign a waiver, just like on the video, for this reason and it is on camera. If she signed the waiver, she has no case. And, the whole point is to speed it up because it would be quite boring to ride one slow. And, most everybody uses their "liquid courage" to get on one anyways. I hope she walks away with nothing.

She claimed to be drunk. It's not a fact. She may have signed a waiver, and maybe she did while sober. Did anyone make the bull go faster? Isn't that the way that ride works? Was she alone, drinking alone? Friends don't let friends ride mechanical bulls drunk, unless they conspired to sue the bar. She eveidently had the ability to walk over, get on and ride the bull until it finally threw her off. It sounds like she was sober to me.

To begin with, did the first person that sued for a like incident succeed in getting a judgment against Johnny Utah's? I think that would have a major bearing on the outcome of this case.

Doesn't the waiver protect the bar to some degree. I'm quite sure that anyone with 1 ounce of gray matter in their cranium has to know that they are going to be thrown off that bull, come hell or high water. It's not there just for a joyous comfortable ride.
The bull is sitting so close to the cushion, and that cushion looks quite thick, I'd think it would be darn near impossible to get hurt unless you landed on your head which is not likely.
Please advise if anyone has heard about the results of either this or the first case. My bet is that the judge will side with Johnny Utah's and he SHOULD TELL THE PEOPLE who admit they were drunk, that they should be going for counseling so as to not wind up getting themselves SERIOUSLY HURT by doing something else even dumber like playing chicken with a city bus or something.

Well, now that I watched the video, I see that the bar DOES require a signed release...so I'm surprised a lawyer even took the case. I guess that's what happens when a New York girl tries to ride a bull. I'm definitely no "cowgirl", but a true Texan, and I handled that bull just fine for a first-timer, even after some drinks!

Most here get it....the woman is an idiot and our legal system sucks when people who do stupid things frequently prosper for blaming someone else for their own stupid choices. Do you all know there is a solution to this problem? It's called "loser pays all", the way the courts are set up in Europe, if ya sue someone and you lose-you pay not only your own legal costs but also the legal fees of the person/organization that ya sued. Not only would that reduce the number of idiots trying to get rich for their own stupidity, it also would prevent businesses from settling suits just because it's cheaper to settle than to fight. In our good old USA, businesses agree to settlements every day when they were NOT in the wrong, they simply do it because it's less costly than a legal battle and ALL the rest of us consumers pay for it in one way or another. This type of legal action did not start with HOT McDonalds coffee; it started over 100 years ago with legal precedent that most ethical lawyers, courts and Judges still follow today. The facts could be presented to a jury made up of people just like you and who only know a small part until the whole truth comes out. It is a jury of peers that decide; whether it is Democrats or republicans and conservative or liberal rich or poor etc. Go to law school and earn a Doctorate in Law and even then it is difficult to determine what is actionable or not. Trial lawyers have saved Billions of dollars to make people more responsible and consumer goods and food and particulary sports of all kinds, i.e. NFL helmuts!!! and Bull riding; because money hungry business want to skimp on safety for the profit at the expense of innocent victoms.
