pecosam - Respectfully, try googling Jose Padilla. Not only did he lose his habeas corpus rights, he also lost due process and the presumption of innocence. His was a famous case mostly because Karl Rove needed to control the news at the time, so he was convicted by White House press releases and kept incommunicado in a military brig. There apparently were many more Americans of Arab descent that were summarily rounded up and jailed by an over-zealous FBI and Justice Department. They were not allowed to speak to a lawyer and were kept incarcerated until FBI investigators were satisfied they were not terrorists.

As for Americans who have had their phones tapped without a warrant, google Fisa Amendments Act.. An update of the 1978 FISA bill, it allows warrantless wiretapping. It was passed as an after the fact legal shield because Bush had ordered the NSA to wiretap communications of American citizens calling overseas WITHOUT bothering to get a warrant. There was a brouhaha about immunity for communications companies that allowed the government to use their facilities to commit these illegal, warrant-less wiretaps.
Also you might want to investigate "carnivore" and the humongous database maintained by the NSA that includes EVERY single phone call made in the US of A. If you call your granny, your number goes in the database along with your granny's. Maybe that is not technically a wiretap, but it sure sounds like a clear violation of the fourth amendment to me.
