    It said that the plaintiffs are challenging Bush's wiretapping policy because they were unlawfully spied upon. Obama's team is asking the judge to support their testimony so their case can stay open.

      if you read the article and the comments that follow the article, i believe the opposite is true.

      the obama team could remove the present objection to allowing classified evidence. they have not done so. or they could ask for a delay in order to study the case. they have not done so.

      if the classified evidence is not allowed, the case is thrown out, as a previous EFF one had been.
