Yes it is so true. Last week an 80 yo lady pulled into the parking lot of a local pharmacy and hit an 80 yo man who was walking. To make matters worse, she backed up and then proceeded forward hitting him again. Guess she wanted to make sure she did it right. Sad but true story - the man passed away shortly afterwards in the emergency. My Mom is 89 and swears she's a good driver. We took her keys away about 6 months ago.

And by the way, the joke isn't in bad taste at all, just thought I'd relate a true-life experience as a followup.-

Thank you LegalBob. In response to your experience one of my elderly "clients" swore that she was a good driver but her son had taken away her keys. She called a locksmith who came out and since he couldn't make a new key for her he drilled out the ignition switch which unlocked the steering wheel and allowed her to start the car with a screw driver. She then drove to a dealer and had them install a new ignition which gave her new keys. Her family then took her car so she reported it as stolen and got it back. They then reported her to the DMV (in California there is a procedure for that) the DMV required her to take a driving test and when she failed twice they revoked her license. She now drives without a license. She says that her driving is her last source of independence and that if she can't drive she will be nothing. In all other ways she is a very sweet and nice lady but when it comes to her right to drive she like a tiger. She is the kind that is always trying to help and do for others but when I mentioned that her driving might be dangerous to others she refused to acknowledge it.

I am afraid that something might happen as you say, however I'm not sure that you would want the case. This lady has no longer has a drivers license so she is uninsured, she is a renter and when I brought in a Lawyer, another volunteer, he drew up her Durable Power Of Attorney for Health Care and a Living Will but stated that there was no reason for a living trust as she have very little to leave to others.

That is a problem in many of these cases. Many elderly people drive but have nothing for the accident victim to go after if there is an accident. At least that's the way it is in California. Another thing is that because of their age and frailty the people that usually get hurt the worst or die in an accident are the elderly drivers.
