[The memos'] language is the precise bureaucratese favored by dungeon masters throughout history. They detail how to fashion a collar for slamming a prisoner against a wall, exactly how many days he can be kept without sleep (11), and what, specifically, he should be told before being locked in a box with an insect — all to stop just short of having a jury decide that these acts violate the laws against torture and abusive treatment of prisoners.
In one of the more nauseating passages, Jay Bybee, then an assistant attorney general and now a federal judge, wrote admiringly about a contraption for waterboarding that would lurch a prisoner upright if he stopped breathing while water was poured over his face. He praised the Central Intelligence Agency for having doctors ready to perform an emergency tracheotomy if necessary. -

This quote from Sen. Claire McCaskill in the article should clarify the question of Bybee's remaining on the bench:

"The lawyers that gave this advice, what's scary to me is one of them got a lifetime appointment on the federal bench," McCaskill said earlier. "Yikes! A lawyer responsible for this kind of advice that clearly went too far in terms of stretching what our law is. It worries me that he's sitting on the federal bench right now.
Anyone who's concerned about "activist judges" should be in favor of Bybee's impeachment. -

Listen to the liberals rant. Why not go after all of those congress men and women that heard what was going to be used and do the same with them. All of them had a schedule to go and get briefed on the tactics to be used to extract information from the terrorists after capture. Only one objected. The rest agreed or asked if these techinques woud be harsh enough. Go after the people who had the chance to reject this and did nothing.

the fact that pelosi and a handful of others are equally guilty is the reason she would not touch impeachment. i've wanted her gone from day one.

but in no way does the complicity of congress excuse bybee, yoo, bush, cheney, or rumsfeld, for their greater role.
if obama and holder continue to protect those involved, they become legal accomplices and equally guilty before the law. -

Why go after the lowlifes in Congress instead of those directly involved in crafting these torture memos & allowing the actions? You seem to want investigations of those who MAY HAVE BEEN informed - which, frankly I doubt they were because the Bush admin never admitted to anything - & exclude those responsible. Kind of like going after the guy selling a dime back of pot on the corner instead of the guy importing hundreds of kilos of heroin or coke.
If those in Congress were complicit, go after them. But do NOT exclude those who were responsible for the illegal activities.

as soon as bybee's name was linked to these memos, he became radioactive. the evidence is that the nytimes is now against him, when in fact, much of this was known during his senate hearing to be confirmed as a judge. back then, no one in congress, or the nytimes, was even willing to raise the issue.

The Democrats must hold democrats to the same standards as republicans. Republicans were blasted for their actions in this last administration and for their current actions. Democrats are no different.

I agree with berkeley. Any democrats that are complicit in the actions of war crimes, pandering to Wall Street and/or banks, or being obstructionist to the well-being of America should be dealt with accordingly and in the appropriate manner.
This sentiment is foreign to republicans that tow the party line and only talk about "the other" party when blaming. True Americans are for America and not just for a party! -
