The government needs to prove intent when undocumented workers are accused of identity theft. They need to demonstrate that the worker must have known that the social security and other numbers they were using were stolen from someone else. Intent is the key to most crimes, and as applied by the government this law was arbitrary.

An "undocumented worker" is an illegal alien by any other name. If they are using a false identity they may not know that it is stolen, but they damn sure know it's wrong. The courts are not applying the law properly, but the fact remains that if you are illegal (that is, in the country illegally) and use an ID that is not your own, you know it's wrong.

      Full stop.
