Plan to ax dealers not Chrysler's decision -lawyer
NEW YORK, May 26 (Reuters) - A lawyer for Chrysler dealers
facing closure as part of the automaker's bankruptcy
reorganization said on Tuesday he believes Chrysler executives
do not support a plan to eliminate a quarter of its retail
outlets.
Lawyer Leonard Bellavia, of Bellavia Gentile & Associates,
who represents some of the terminated dealers, said he deposed
Chrysler President Jim Press on Tuesday and came away with the
impression that Press did not support the plan.
"It became clear to us that Chrysler does not see the wisdom
of terminating 25 percent of its dealers," Bellavia said. "It
really wasn't Chrysler's decision. They are under enormous
pressure from the President's automotive task force."
He added the government task force, which he criticized for
having no members with retail experience was, in effect,
attacking U.S. entrepreneurs.
"What is the next task force? Shoe stores? Pizzerias?"
Bellavia said at an event in Manhattan to publicize the dealers'
concerns ahead of a bankruptcy court hearing.-

He speaks for them without knowing for sure? He 'believes.' Is this like one of those 'anonymous sources' that rumor mongers use all the time? I know, someone could ask the principals themselves. That might work. Meanwhile, I'll wait until someone with a brain gets all their ducks in a row, finds 'real' evidence of wrong doing, & offers up that verifiable information.

t his work builds upon the research done by numerous parties, most notably Joey Smith. It is a follow-up to my original post, entitled "Did anti-Obama campaign contributions dictate which Chrysler dealers were shuttered?" The odds that these closings occurred without partisan bias are roughly equivalent to the odds that Jean Claude Van-Damme will grab a Best Supporting Actor Oscar next year for a remake of Terms of Endearment.
How did the U.S. government's "car czar" decide which Chrysler dealers to close and which would remain open? No one appears to know, not even the President of Chrysler:
.Lawyer Leonard Bellavia, of Bellavia Gentile & Associates, who represents some of the terminated dealers, said he deposed Chrysler President Jim Press on Tuesday and came away with the impression that Press did not support the plan...
"It became clear to us that Chrysler does not see the wisdom of terminating 25 percent of its dealers," Bellavia said. "It really wasn't Chrysler's decision. They are under enormous pressure from the President's automotive task
Dealers on the closing list donated millions to Republicans, $200 for Obama
The initial pass at the list of shuttered dealers showed they had donated, in the aggregate, millions to Republican candidates and PACs and a total of $200 to Barack Obama.

It's unfortunate that Mac "The Nice" McLarty is involved with the Obamamites, and was so involved with "Slick Willy" and Hillary.
Once I had the honor of meeting Mr. McLarty during business in late 1978 or mid-1979. What I remember about this gentleman (indeed) was his relaxed, friendly demeanor; AND his masterful CALLIGRAPHY. I nearly wished I could keep the receipt just to hang it on the wall, LOL! The MOST BEAUTIFUL handwriting I've ever seen. If I recall correctly, he used a fountain pen. It's getting to where all one can do is sigh and shrug one's shoulders when given the daily "Obama Report". Perhaps there is something to the term "sinister" when it comes to Lefties:
sin·is·ter (s?n'?-st?r)

Suggesting or threatening evil: a sinister smile.
Presaging trouble; ominous: sinister storm clouds.
Attended by or causing disaster or inauspicious circumstances.

Heraldry Situated on or being the side of a shield on the wearer's left and the observer's right.

Remember who the car czar is - Steven Rattner
Reply
In March, Steven Rattner, the leader of the Obama administration's auto task force, was the man who sat face to face with General Motors CEO Rick Wagoner at a Treasury Department meeting and fired him.
Now it's Rattner's turn in the hot seat.
The Wall Street Journal reported Thursday night that Rattner was involved with payments at the center of an investigation into an alleged kickback scheme at New York state's pension fund. Sourcing their information to a "person familiar with the matter," Journal reporters Craig Karmin and Peter Lattman reported that Rattner, who was then an executive at Quadrangle Group, an investment firm he co-founded, met with a "politically connected" consultant to discuss a finder's fee. Quadrangle later paid a $1.1 million fee, and received a $100 million investment from the New York State Common Retirement Fund.
New York Attorney General Andrew Cuomo and the Securities and Exchange Commission have been investigating whether payments to middle men by private equity firms including Quadrangle constituted improper kickbacks in exchange for investments from the pension fund, which is worth $122 billion.

Rattner's name has also come up in the pay-for-play scandal in New Mexico - the scandal that derailed the Bill Richardson nomination-

GM bondholders to board: Pound sand

General Motors announced this morning that its bondholders had rejected a plan to give almost 40% of a restructured GM to the UAW while they got only 10% for their investment. GM needed 90% of its bondholders to agree to the government-imposed deal for it to win approval and keep the company out of bankruptcy. Instead, GM says they got “substantially less” cooperation from their creditors:
I believe Obama's riding rough shod over bankruptcy laws and state franchise laws is going to wind up before the supreme court

The GM bond holders won't get any further
White & Case, made famous by its irreverent lawyer Tom Lauria, who led a valiant fight for the non-TARP lender committee until its disbandment after holdout after holdout decided fighting against the US government was not reasonable, has been retained again, this time by Indiana Pension Funds, holders of Chrysler first-lien claims, who are continuing where the non-TARP lenders dropped off.
In several motions with the Chrysler docket earlier, the Indiana State Teachers Retirement Fund, Indiana State Police Pension Trust, and Indiana Major Movers Construction Fund, fiduciaries for "approximately 100,000 civil servants, including police officers, school teachers and their families" have objected to the 363 sale, and demand Judge Gonzalez should block the sale, claiming "the plan is illegal and tramples their rights."
Among other things, the Indiana Pensioners seek to appoint both a trustee and an examiner in the case (an examiner was eventually retained in the Lehman bankruptcy), claiming that the company "has ceded control over their business and their restructuring efforts to the United States Treasury Department" which is using the Chapter 11 process to reward creditors that the "government deems politically important."

Their case was heard today
Reply
On Tuesday, Chrysler avoided a possible roadblock to its sale when U.S. District Court Judge Thomas Griesa denied a withdrawal motion filed by the attorneys representing the Indiana state funds.
The funds had argued that a legal review was needed because of the unprecedented involvement of the Treasury Department in the case and its use of federal bailout funds for bankruptcy financing.
Griesa noted that the funds will have the right to appeal Gonzalez's ruling on the sale motion if they don't like it. Kurtz said after Tuesday's hearing that he fully expects the sale motion to end up in district court.
The three funds, which include the Indiana State Teachers Retirement Fund and Indiana State Police Pension Trust, along with the Indiana Major Moves Construction Fund, hold a combined $42.5 million of the total $6.9 billion in secured debt. They bought the bonds in July 2008 and paid 43 cents on the dollar.

Certainly, and it is no surprise when one considers what Lenin, and ESPECIALLY Stalin, did to his "Useful Fools" once he was done USING them for his needs. Obama, the "Community Organizer" is adept at such treachery, as every Socialist/Communist is expected be. His Hawaiian Communist Mentor, Frank Marshall Davis, taught the then young Obama well. And as I said before, Bill Ayers was there to teach 'THE ONE" the finer points of screwing one's "followers" when and if there was a political or monetary profit in doing so. You state: "guess you've never heard the term .. TO THE VICTOR GOES THE SPOILS..."
The only problem (a BIG ONE) with this saying applied to today's topic is that it is ABOUT AMERICA, not some country we were at war with. But then again, the Left has been AT WAR and out to DESTROY the United States since the time of Lenin.
Perhaps, since you have succeeded in suckering a majority of voters into electing this SOCIALIST as President, you may claim victory over the FREEST, most SUCCESSFUL COUNTRY ever known to have been established. But it is a PYRRHIC VICTORY, in that by "winning" it, you have in fact LOST. You will realize this FACT sooner or later, when one of your "sacred cows" has been gored and slaughtered by your fellow Obamamites; all for the good of "THE STATE", of course. It is merely History repeating itself.
For you see, as there is no HONOR among thieves, there is none among SOCIALISTS, for they ARE THIEVES in the business of "Wealth Distribution", and a law unto themselves.
Enjoy your "VICTORY", for it will be a BRIEF celebration, just as the Policemen and Teachers Unions Pension Funds have learned to their chagrin.-

Unreal. After Weeding Out GOP-Linked Dealers Chrysler Looking To Open New Dealerships!
http://gatewaypundit.blogspot.com/2009/05/unreal-a...
More Hope and Change...
** Earlier it was reported that the Obama Administration may have targeted GOP donors in deciding which Chrysler dealerships would have to close their doors.
** Last night it was discovered that a Big Dem Donor Group was allowed to keep all 6 Chrysler dealerships open.... And, their local competitors were eliminated by Obama's task force.
** The closings also tend to be in "Red" Counties where Obama lost.
** Even Rep. Vern Buchanan (R-Fla) lost his Chrysler dealership in Florida and found out from a colleague on the House floor.
** Lithia Motor Group's owners gave $15,000 to two Democrat candidates and support nationalized healthcare. They will likely lose just two of 29 dealerships and gain 5 more.
** One report claims the odds that these Chrysler closings occurred without partisan bias are less than 1%. -

That perennial question, "Does the end justify the means?" is meaningless as it stands: the real and only question regarding the ethics of means and ends is, and always has been, "Does this particular end justify this particular means?"
The second rule of the ethics of means and ends is that the judgment of the ethics of means is dependent upon the political position of those sitting in judgment.
The third rule of the ethics of means and ends is that in war the end justifies almost any means.
The fourth rule of the ethics of means and ends is that judgment must be made in the context of the times in which the action occurred and not from any other chronological vantage point.
The fifth rule of the ethics of means and ends is that concern with ethics increases with the number of means available and vice versa.
The sixth rule of the ethics of means and ends is that the less important the end to be desired, the more one can afford to engage in ethical evaluations of means.
The seventh rule of the ethics of means and ends is that generally success or failure is a mighty determinant of ethics.
The eighth rule of the ethics of means and ends is that the morality of a means depends upon whether the means is being employed at a time of imminent defeat or imminent victory.
The ninth rule of the ethics of means and ends is that any effective means is automatically judged by the opposition as being unethical.
The tenth rule of the ethics of means and ends is that you do what you can with what you have and clothe it with moral garments.
The eleventh rule of the ethics of means and ends is that goals must be phrased in general terms like "Liberty, Equality, Fraternity," "Of the Common Welfare," "Pursuit of Happiness," or "Bread and Peace."-

All one has to do is see the list of owners(and the political contributions that they made),whose dealerships were closed, and the list of owners(and the political contributions THEY made),whose dealerships weren't closed to see that this was strictly political.

The owners whose dealerships were closed didn't contribute any money to the Obama campaign, the ones that were left open did contribute to the Obama campaign.
That is about as blatant as you can get. -

Obama will likely turn out to be viewed as the most politically oriented President since Nixon. Every step is a political calculation to centralize power from the dealership closings, US census power grab, position on immigration, demonizing CEOs and the private sector, attacking Republicans, nominating Sotomayor, funding Acorn, UAW involvement with Detroit, .....

A list! - let's go thru it.

- Closing auto dealerships is a cleverly unexpected way to seize power.
I would have seized the fast food restaurants myself.
- The US census power grab is clever because no one knew he had grabbed it . And obviously, with that power, he will be unstoppable.
- Yes, his position on immigration is a centralizing maneuver designed to ignore the issue, like every one of his predicessors. The clever fiend.
- Demonizing the CEO's is a clever ploy. Before Obama we regarded them as
angels who floated above on golden parachutes; now we look at them and think
'I wan't my tax money back'.
- Attacking Republicans is not a power ploy. We all do it. Even Republicans do it.
Actualy, Obama mostly ignores them. it is the Republicans who can... not... stop...
talking about him.
- Nominating Sotomayor is a brilliant move; she has been certified by the senate twice already so she should be a shoe in. Pure power ploy.
- Funding Acorn; - yawn. Acorn is a public service group that has been getting funding for decades. In other words, it does nothing interesting and nothing particularly well.
- UAW involvement - the last thing we want is for a lot of autoworkers to get united
in the making of cars in Detroit. That could lead to production , and worker satisfaction,
and better cars, and do you realize what it could do to your investments in Chinese sweat shops?
Not a bad list;
but it ignores that Obama is really a dim kenyan who is illiterate.
You almost make him sound smart .

Just for you PC; 80% of dealers gave a disproportionate amount of money to republican candidates. Looks like there was no choice but to hit conservative dealerships as most are owned by conservatives. By the way, those left are owned by conservatives. So much for your conspiracy theory. You really need to watch MSNBC. They're not half bad in their investigative journalism.
