A Bad Call on Gay Rights »
Posted By david_nwpa 4 months, 3 weeks ago in Political NewsThe Obama administration, which came to office promising to protect gay rights but so far has not done much, actually struck a blow for the other side last week. It submitted a disturbing brief in support of the Defense of Marriage Act, which is the law that protects the right of states to not recognize same-sex marriages and denies same-sex married couples federal benefits. The administration needs a new direction on gay rights.

Attorney General Holder's positions on DOMA are excessive at best, and downright hurtful at worst. He must uphold the laws of the land and defend them in court, but he did not need to use such a vigorous defense, nor did he need to draw the comparison of same sex marriage to incestuous marriage. There exists no comparison between the two. In essence, Obama's team backpedaled on their campaign promise to end DOMA. Obama is not an ally for gays and lesbians that can be trusted.

I honestly don't understand the Justice Dept.'s take in this brief.

While Obama never said during the campaign that he'd support same-sex marriage, you're right that he said he'd end DOMA. I never expected the arguments Holder used here, and I find it disappointing.

NY Times links don't seem to be posting correctly lately--they may be trying a new strategy in trying to prevent non-registered users from seeing their stories.

This didn't post the first time I tried, so forgive me if it ends up as a double post, but I liked Howard Dean's comments in this regard last night:

Not just what marriage is, but they want to overthrow a foundational principle of what jurisprudence is all about. One need not look far across the English speaking world for state/provincial or federal case law where cases--be they tax, tort, or marriage & family--have turned on the meaning of words. That is to say, where justices have resolved an issue by resorting to the plain meaning or the dictionary meaning of a word or phrase as used in its respective society.
Never in the history of mankind have justices force-fed the plain meaning of a term to society. To do so turns jurisprudence itself upside down. For thousands of years, these meanings have held true and have been consistent across time, geography, culture, religion, and levels of morality or immorality:
Husband: a man, born male, who takes a woman to be his lawfully wedded wife.
Wife: a woman, born female, who takes a man to be her lawfully wedded husband.
Marriage: the legal and spiritual bond between a husband and wife.
Nothing stated above has the first shred of encroachment on the rights or denial of rights of any/all homosexuals or lesbians. It's apples and oranges. That the above is perceived as an encroachment is a problem, but it's just a matter of discerning who owns that problem. People are free to perceive anything/everything they want. By so doing, they own the problems that their own perceptions conjure up.

Petesake ... for petesake!! Your attack on David is unwarranted and unnecessary. I personally do not believe gay rights are equal to civil rights fought for by American Blacks. Whatever I may think, like believing marriage is an exclusive right for men and women, does not matter when the conversation turns nasty. Every couple has a right to live hassle-free. Whatever happens behind a closed door is nobodys business. Unless you are invited in, stay your ass out of people's lives and homes. Try to be as good a neighbor to you gay friends as they try to be to you. For petes sake!!

Anyone who thinks they will receive everything they promise, Well I have some cheap swap land for you for sale. Ignorance is bliss in voter land. I'm ashamed of the people being hoodwinked in America, I thought they were smarter then that! -

The gay marriage argument is a joke. It isn't about equal rights. It's about forcing society to accept homosexuality as normal. It isn't. Using animals, highly biased "studies", or any other bs out there to back up homosexuality as anything other than an aberrant personal decision is laughable. In my opinion homosexuality is a complete failure of personal esteem and since there are plenty of people in the same boat, it must be ok. Personally, if someone chooses that path in life, so be it. Why does society (the rule) have to bend to the will of these people (the exception). It should not ever unless the exception becomes the rule; and I don't mean by law. This is all about the squeaky wheel getting the grease at the expense of everyone else.

To me, homosexuality is really no different than religion at its base. Be gay, but why can't you be gay without having to subject everyone else to it? Be religious, buy why can't you be religious without having to subject everyone else to it? The advantage religion has over homosexuality is the generally positive affect religion has on society as a whole (until bombs are strapped to people or the like). Homosexuality is self serving to that group at the expense of others. Others being the balance of society that does not necessarily plug into the debate (and probably doesn't care that much until it affects them directly as in say a benefits package having to be paid out to a homosexual partner by a small business where the owner(s)/worker(s) don't believe in homosexuality). Since gays are loud and organized (not dissimilarly to religions), they are slowly getting their way.
It's just my opinion, I could be wrong but hot-damn what a controversial subject! -
