Howard Dean protested on The Rachel Maddow Show that he doubts Obama himself was aware of the recently filed brief in defense of the Defense of Marriage Act. But weeks ago, many new outlets, including my column on this site , covered the fact that the President has the legal right to refuse to defend clearly unconstitutional laws.

Gays and lesbians are not looking to President Obama as a genie doling out magical rights and benefits just for being gay. We are not playing games like Let's Make a Deal. Behind door number 3 is a repeal of DOMA and DADT. Instead, we picked door number 1. That leads us to benefits for partners of federal employees. Woo hoo. He has the power to address civil rights as a leader, and yet he chooses to sit on his hands.

Now I know, being the leader of the free world, President Obama has a lot of issues to settle. However, it would not take that much effort to put a stop to the discharges from DADT. All he need do is sign an executive order. It worked for Truman, it can work for Obama.

Well, I hate to be the one to explain a rights struggle to the first Black President, but the equality movement is not a grab bag of rights. You don't get to reach in and see which prize you've won.>>>>

I realize it's a political firestorm to give gays rights. I realize it could even cost him reelection. But if you're not going to do what's right and Constitutional, then WTF is the point of being elected anyway?
