Gov. Arnold Schwarzenegger has declined to defend the constitutionality of Proposition 8, telling a San Francisco judge that the legality of the anti-gay marriage measure is for the courts to decide.

    Governor Schwarzenegger followed his duty and is allowing the courts to reach a fair and just conclusion to the Prop 8 debacle. Although he is obliged to uphold the laws of California, he is equally obligated to uphold those laws which meet US Constitutional muster. If he firmly believes that Prop 8 does not rise to that level, and it doesn't, then he is under no obligation to defend it in court.

      This issue really points to the importance of our republic with rule-of-law rather than the tyranny of the majority that results from direct democracy.

          I felt pretty bad for this young man on c-span sometime back,very clean cut,and quite handsome.At the end of his oration he said,really all I want is to marry my husband.
