The law in New York could go either way as to whether Governor Paterson had the constitutional authority to select a new Lieutenant Governor. It is likely that a Republican challenge will come swiftly and without recourse for Governor Paterson. The question will be, what to do about Lt. Governor Ravitch. Will he be removed from office, or will the court keep him in place?

As I read the NY Constitution, it states that the President of the Senate shall serve as temporary Lieutenant Governor and assume all the duties of the office. It does not say anything about assuming the title too. The case is similar to the role of the Vice President assuming the office of the President minus the title (that mess was cleared up with the passage of the 25th Amendment.)
