    It isn't fair use...as long as the image is around and being sold in print form, as is being done, then there is a copyright owner.
    
    You can't just take artwork from the internet and use it as for you own devices unless you have permission.
    
    It's the law...you should know that...

        I was not commenting on whether or not the guy was plagiarizing, merely that the definition of the term was accurate and that plagiarizing DOES represent a lack of creativity on part of the plagiarizer

        This issue started with this ludicrous statement on copyright law from Unusual suspect, regarding "The Scream":
        
        "You can't just take artwork from the internet and use it as for you own devices unless you have permission."
        
        So... what, exactly, is the internet..... The Lourve? The MMOMA? What an absolutely boneheaded claim. If something is being displayed on the internet, it has ALREADY BEEN USED for somebody's devices. How the hell do you think it GOT to the internet??
        
        This is separate from the issue of plagiarism. If I post an image of "The Scream" on the internet it would not be plagiarism. My posting an image of The Scream, accompanied by the claim that I painted it, would be plagiarism. Because I'm not Edvard Munch. I'm not even Norwegian. Although I am Swedish......
        
        Plagiarism doesn't necessarily represent a lack of creativity. It represents a lack of honesty.

        All I know is it's against the law to use either copyrighted artwork/photographs recognized as famous by an unknown artist or a famous piece of artwork/photograph by a famous artist without permission.
        
        I know this because it's part of my daily work, to get permission to reproduce artwork on magazines I design.
