Has anyone ever questioned all those old, white guys who have dominated the Supreme Court over the years as to whether their experiences as white men ever skewed their ability to judge a case involving minorities? Does a person's whiteness color that person's thinking about other races? Can a white person truly know what it feels like to be a person of color?

Why is it that blacks average 11% of the national census, yet constitute the majority of incarcerated prisoners? Iowa's black population is only about 2%, yet blacks make up 24% of its prisoners. Maryland is 28% black, but its prison population is 77% black. Could it be that white judges have an anti-black bias? Should this disqualify all whites from becoming judges?
Why is it that as soon as a person of color comes up for consideration as Supreme Court Justice, it is immediately assumed that she is biased because of her proclamation of pride in her race? While a white person is automatically assumed to be unbiased, regardless of his experiences?

First off, Sotomayor was part of a panel of judges that ruled on this. Second, the ruling was based on existing precident, so turning it over would have been *GASP* Judicial Activism. Third, the Supreme Court does not rule on whether or not the decision was incompatible with the STATE'S constitution, but whether or not it is compatible with the FEDERAL Constitution.

and in politics, perception is everything.
right or wrong, true or false, you can argue about it all you want, you can deny it all you want, you can feebly try and turn it around on the dems all you want, but none of that matters, cause thats how the world sees you guys.

Wow, suddenly I am beginning to feel so powerful and secretive. D*mn. Now I'm sure my neighbor is hoarding some automatic weapons in his basement. I saw some metal tubes down there. There's a strange RV parked in his driveway. I suspect that is a mobile biological weapons lab. Gonna call Homeland Security to check him out just to be sure.
I think I am going to invite my other neighbor to go hunting with me next weekend. I wanna show off my new 12 gauge.

Hey, the republicans are writing their own obituary. Can't complain to much about that. I hope the Independence party is ready to fill the gap. I think they'd be a much better opposition party than the republicans. I might even vote for them from time to time.

Skeptic - You are absolutely correct. The Democrats were not racist because they did not object to Estrada on race issues.

The Dems objected to Estrada purely on policy issues.
Now you can debate about the appropriateness of pushing liberal policies versus conservative ones, or the fairness of using the filibuster to block Estrada's nomination. Go for it.
However, let me reiterate. The Dems objected to Estrada purely because of policy issues, NOT RACIAL.
So, thank you. Bringing up the name of Miguel Estrada just helped prove that Democrats are not and were not racist.
For Sotomayor, the main issue of contention for the Republican senators was her proclamation of pride in her race. So what is the problem with that? Aren't German-Americans proud to have German heritage? Aren't British-Americans proud to be British?
Aren't French-Americans proud to be French? Aren't Dutch-Americans proud to be Dutch?Aren't Japanese-Americans proud to be Japanese?
Why can't a Hispanic-American be proud to be Hispanic?
Since the PRIMARY objection raised by Republicans is based on race, the only conclusion I can arrive at is that the Republicans are rejudiced against people of Hispanic race.
