This is a rather extreme interpretation of the law. I don't think that a driver, alone in his "own" vehicle, should be subjected to an anti-smoking ordinance. Smoking sooths the nerves of addicts and that is what this man was doing while driving his truck. As a former smoker myself, I understand the power of this addiction and have empathy for smokers. There is a difference between protecting the publics health and persecution and this citation crosses that line unambiguously. As long as he isn't throwing cigarette butts out the window, he should be left alone.

The whole concept of having governments which are allowed to use Force, and to tax us to provide EnForcement, of this or any other, is totally wrong. We have our own minds and should allow no other human to dictate our choices. To do otherwise lowers one to the level of all other animals, and worse, denies our right to life.

I am my self totally opposed to smoking.

However, I also believe in personal freedom and choice (of adults).
If some one chooses to smoke, that is his problem.
Just as some of us eat to much, drink to much, don't exercise (enough), watch to much TV, play to much video games or internet games, etc .....
Where do you draw the line......
As long as it doesn't (OBJECTIVELY) bothers me (e.g. smoke in my face), I'm against the banning of smoking in certain public places, e.g. cafe's, bars, pubs, restaurant, (etc.) as I do have the choice to go to one where it not allowed (by private owners choice) or is allowed.
So this whole story about this truck driver is ridiculous.
That being said, I do agree that smoking should be forbidden while driving, but for a totally different reason: smoking while driving can (and does) distract while driving (e.g. finding a cigarette, lighting your cigarette, dropping your cigarette, smoke in your eyes, etc .....)
That's why cigarette smoking while driving (for ALL, including private cars) was (and is) banned in certain countries.
However, in this case, the reason behind the fine is ridiculous and an infringement of personal freedom and choice.
